PREAMBLE

The following provisions set out the general terms and conditions of sale for the products offered by DelFine® on its website at the following address: www.delfinebijoux.com.
DelFine® is a company whose registered office is located at 24 A ruelle des Attes 97436 Saint Leu - Reunion Island and is registered with the Registre du Commerce et des Sociétés de Saint Pierre de la Réunion under siret number 520 718 677.

ARTICLE 1

SUBJECT
The purpose of these conditions is to define the terms and conditions of sale between DelFine® and the customer, from the order to the services, including payment and delivery. They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.

ARTICLE 2

PRODUCTS
DelFine® aims to offer its own jewellery for sale while stocks last. These products are those listed for sale on the day of consultation by the user. When the product is unavailable, a notification is displayed on the site, otherwise, in the event of an error, DelFine® undertakes to notify the customer by e-mail as soon as possible. If the product has already been paid for, DelFine® undertakes to reimburse the customer for the price of the article. The products offered for sale are described and presented as accurately as possible. However, DelFine® cannot be held responsible for any errors or omissions in this presentation. The photographs and texts illustrating the products are not contractually binding.

ARTICLE 3

PRODUCT PRICES
Prices are given in euros, including VAT. They include French VAT, applicable on the day of the order. If the VAT rate were to be modified, these changes would be reflected in the price of the articles. DelFine® reserves the right to modify its prices at any time. However, these prices cannot be modified once the order has been validated. The prices indicated do not take into account delivery costs, which will be added to the order total and will be specified to the customer when the order is finally validated. Delivery in Metropolitan France is made within an average of 4 to 8 days from receipt of the order by DelFine®, notwithstanding any fortuitous event or force majeure that would delay delivery beyond the control and diligence of DelFine®. The amount depends on the country of delivery. The products remain the property of DelFine® until full payment of the price.

ARTICLE 4

- PLACING AN ORDER

Customers who place an order directly on the www.delfinebijoux.com website must follow the following procedure: the customer will select the various products in which he/she is interested and successively click on the "Add to my basket" link. At any time, the customer may either obtain a summary of the products selected by clicking on the "My basket" link, or continue shopping. The customer completes the order by clicking on "Payment" in order to validate it correctly. They will then specify the delivery method chosen, depending on the country. The order can only be registered on the site if the customer has clearly identified himself by entering his e-mail address and password, which are strictly personal to him. Once identified, the user must validate the delivery address and an order form will appear summarising: the nature, quantity and price of the products selected by the user, as well as the chosen method of payment, the user's contact details and the delivery address for the parcel. Any order implies acceptance of the prices and descriptions of the products available for sale.

- ORDER VALIDATION

The order is validated once all the fields have been completed by the customer. The order is final when the customer clicks on "Validate". Payments can only be made by Payplug or Paypal. DelFine® will acknowledge receipt of the order as soon as it has been validated by e-mail.

ARTICLE 5

PAYMENT AND TRANSACTION SECURITY

The amount due by the customer is the amount indicated on the DelFine® order confirmation. In order to ensure the security of payments, the www.delfinebijoux.com site uses the Paypal secure payment service. Payment will be made on the internet at www.delfinebijoux.com by credit card (Blue, Visa, Eurocard/Mastercard) via the secure PayPlug site. In any event, DelFine® reserves the right to refuse any order or any delivery in the event of an existing dispute with the customer, in the event of total or partial non-payment of an order, in the event of refused payment by bank card or for other reasons that DelFine® reserves the right to explain to its customer. DelFine® cannot be held liable in this case. When the order is validated, the payment request is routed in real time to the secure remote payment manager. The telepayment manager issues an electronic certificate.

ARTICLE 6

GUARANTEES

All products may be exchanged or refunded. The exchange or refund must be made within 7 days from the date of receipt or collection and the return of the item(s) within this period must be accompanied by the DelFine® invoice and the item in its original packaging to the following address:

It is essential that the customer makes a return request by email (shop@delfine-paris.com) in order to obtain a return authorisation. The seller will refuse any damaged item that has not been the subject of remarks or express reservations by the customer upon delivery. To be accepted by DelFine®, items must be returned in their original condition without having been worn. Only items returned in their original packaging will be accepted. Consequently, returns of worn items and damaged packaging will be refused. DelFine® thus reserves the right to accept or refuse the returned item depending on its qualitative condition. All articles are subject to a contractual guarantee, which does not preclude the legal guarantee provided by articles 1641 et seq. of the French Civil Code. The user benefits from a guarantee allowing him to return defective items in accordance with articles L 211-4 et seq. of the French Consumer Code.

The exchange

All items on the www.delfinebijoux.com website are exchangeable, subject to stock availability. All you have to do is mention the item you wish to exchange when you request a return. We will accept it on receipt of your return, subject to availability.
If the new order is for a higher amount, the customer must enclose payment for the balance by cheque with the exchange request. Conversely, if the amount of the exchange is less than the initial amount, the customer will receive a refund of the difference directly via Payplug or their Paypal account.
To return an item, simply follow the instructions below:
Send an e-mail to "shop@delfine-paris.com" and wait for a return authorisation / Use the original packaging to return the product / Send your parcel by post to the following address: DelFine - 24 A ruelle des Attes - 97436 Saint Leu - Reunion Island - France.
In the case of an exchange in France (and of an exchange only), the postage for the second shipment is free.

Reimbursement

Refunds will only be considered if there is a problem with the products delivered. If the product is defective, a refund may also be requested within 10 days of receipt of your complaint, if it was purchased on the www.delfinebijoux.com website. DelFine® reserves the right to judge a product as defective on the basis of the customer's explanations. The product will be considered defective in the following cases: damaged clasp, broken jewel. DelFine® undertakes to reimburse the customer within a maximum of 30 days by credit card or by cheque at the customer's discretion.

Please note that we do not accept parcels sent carriage forward.
Please note: you will be credited back the amount of your order, less the initial delivery costs. However, the customer must return the item in its original packaging. The parcel must be returned with the authorisation of DelFine®.
In all cases, any request for exchange or refund must be made by e-mail to the address "shop@delfine-paris.com". All items are subject to a contractual guarantee, which does not preclude the legal guarantee provided by articles 1641 et seq. of the French Civil Code.

Loss or theft

An order that is not received may be reimbursed if the loss is reported within a maximum of one month.

After-sales service

All our models come with a 30-day guarantee from the date of invoice. The guarantee begins on the date the order is received.
Only the purchase invoice is valid as proof of warranty.
The defective product must be sent to the following address: DelFine - 24 A ruelle des Attes - 97436 Saint Leu - Reunion Island - France. Shipment is at the customer's expense.
All jewellery under guarantee will be repaired or exchanged free of charge on presentation of the invoice. However, if the customer carries out the repair himself/herself and the jewellery is damaged, the customer will have to pay repair costs.
If there is no invoice for the jewellery or if the guarantee period has expired, the customer will be invoiced for the repair.
If the bracelet is under guarantee, it must be accompanied by the invoice dated within the last 30 days.
For greater security, we advise you to opt for a recorded delivery service: lettre max S.
You can then track your shipment on the www.laposte.fr website.
Our repair will reach you within a maximum of 3 weeks by recorded delivery.
DelFine® cannot be held responsible in the event of loss by the Post Office.

ARTICLE 7

INTELLECTUAL PROPERTY

All elements of the DelFine® site such as products, visuals, including the underlying technology, are protected and any fraudulent use will be prosecuted. They are the exclusive property of DelFine®. Any user who has a personal Internet site and who wishes to place on his site, for personal use, a simple link referring directly to the DelFine® site, must request prior authorisation from DelFine®. In addition, any hypertext link to the DelFine® site using framing, deep-linking, in-line linking or any other deep-linking technique is strictly prohibited. In all cases, any link, even tacitly authorised, must be withdrawn at the request of DelFine®. Hypertext links may lead to sites other than www.delfinebijoux.com. The latter declines all responsibility in the event that the content of these sites contravenes the laws and regulations in force.

ARTICLE 8

INFORMATION TECHNOLOGY AND CIVIL LIBERTIES

DelFine®, for the needs of its activity, reserves the right to collect nominative data relating to users of the site, in particular by means of "cookies". The consumer acknowledges that he/she is aware of this. To this end, the automated processing of information, in particular the management of users' e-mail addresses, has been declared to the CNIL. In all cases, and in accordance with the law of 6 January 1978, the consumer also has the right to access and rectify any information concerning him/her contained in the files of the company DelFine®. Any customer of the site may at any time oppose the commercial use of the said data and also benefits from a right of access, rectification and deletion of the data concerning them, directly on the Internet via the contact section of the site.

ARTICLE 9

SIGNATURE AND PROOF

In all cases, the online provision of the bank card number and the final validation of the order shall constitute proof of the completeness of the said order in accordance with the provisions of the Law of 13 March 2000 and shall constitute payment of the sums incurred by the entry of the items appearing on the order form. This validation is equivalent to a signature and express acceptance of all operations carried out on the site. However, in the event of fraudulent use of his/her bank card, the customer is invited, as soon as this is discovered, to contact the DelFine® customer service department by sending an e-mail to "shop@delfine-paris.com". The computerised registers, kept in the computer systems of DelFine® in reasonable conditions of security, will be considered as proof of the communications, orders and payments that have taken place between the parties. In all cases, validation of the order constitutes signature and express acceptance of all operations carried out on the site.

ARTICLE 10

CUSTOMS DUTIES

Any order placed on the site and delivered outside France may be subject to any taxes and customs duties that are imposed when the parcel reaches its destination. These customs duties and any taxes associated with the delivery of an item are the responsibility of the customer. DelFine® is not obliged to check and inform its customers of the customs duties and taxes applicable. To find out, it is up to the customer to check with the competent authorities in their country.

DISPUTES / APPLICABLE LAW

The language of these general terms and conditions of sale is French. This contract is subject to French law. In the event of a dispute with a customer, the French courts shall have exclusive jurisdiction.

ARTICLE 11

ENTIRE CONTRACT

These general terms and conditions of sale and the order summary sent to the customer form a contractual whole and constitute the entire contractual relationship between the parties.

ARTICLE 12

DELIVERY

Products are dispatched with their supporting invoice to the delivery address indicated by the customer when placing the order. All orders validated before 1pm are dispatched within 48 hours.
The delivery times indicated are indicative times from the day following that on which the customer validates his/her order and correspond to the processing and delivery times of the products. Under no circumstances can they be enforced, but in the event of an unusual delay, an e-mail will be sent to you. DelFine® declines all responsibility in the event of excessive delivery times due to postal services or means of transport, as well as in the event of loss of the products ordered or in the event of strikes. Transport risks are borne by the customer, who must lodge a reasoned protest with the postal services or the carrier within three working days of the delivery date.

Despite all the care taken by DelFine® in preparing the packages, a product may be missing. Similarly, after the parcel has been transported, one of the products may prove to be defective. This is why, on receipt of the order, the customer must check the conformity of the products received. Any anomaly concerning the delivery (missing or broken product, damaged parcel) must imperatively be notified on the day of receipt or at the latest on the first working day following receipt, to the DelFine® customer service department by registered mail addressed to : DelFine - 24 A ruelle des Attes - 97436 Saint Leu - Reunion Island - France.

Any claim made after this period will be rejected and DelFine® will be released from any liability. DelFine® reserves the right to ask the customer to return the defective product. If the aforementioned conditions are met, DelFine® will then exchange or reimburse the defective product(s), or reship the missing product (subject to the Buyer's request being well-founded).

DELIVERY TIMES AND RATES

The delivery times indicated are the indicative delivery times of our carriers in working days. All prices are in euros. Tracked letters are delivered by La Poste in 4 to 8 working days (for metropolitan France). It is delivered to the delivery address indicated on your order form.
If you are absent, the postman will leave you a delivery notice with details of how and where you can collect your parcel. Delivery times are generally 15 days. You can track your parcel on the www.laposte.fr/csuivi website. Your tracking number will be sent to you by e-mail as soon as your order has been dispatched. If you have not received your tracked order after 10 days and no delivery notice has been left, please check the status of your parcel on the La Poste website (and contact us by e-mail shop@delfine-paris.com).

DAMAGED PACKAGES

We ask you not to accept a damaged parcel (a box with visible signs of having been opened and/or damaged): it must be refused. Packages leaving DelFine® warehouses are always impeccable and must be delivered to you in the same condition. If a damaged parcel has been left in your letterbox or received by your caretaker, the parcel is considered to have been "accepted as is". If no reservations have been made, we will not be able to take into account any missing items, nor will we be able to pay any compensation.
